1. Account Terms

To access Aksharum, you must create an account. The following conditions apply to all accounts on the platform:

• Accounts must be registered by a human. Accounts created by bots, automated methods, or scripts are not permitted.
• You must provide your legal full name, a valid email address, and any other information required during the signup or onboarding process.
• Each login credential may only be used by one person. A single login shared by multiple users is not permitted. Separate logins must be created for each user.
• You are responsible for maintaining the security of your account and password. Aksharum shall not be liable for any loss or damage resulting from your failure to maintain account security.
• You are responsible for all activity that occurs under your account, including content posted or actions taken by sub-users under your school tenant.
• One school or legal entity may not maintain more than one active account without prior written approval from Aksharum.
• You may not use Aksharum for any illegal or unauthorised purpose. You must not violate any laws in your jurisdiction, including copyright, data protection, or education laws.

2. Acceptable Use

You agree to use Aksharum only for lawful purposes in connection with managing your educational institution. The following conduct is strictly prohibited:

• Attempting to gain unauthorised access to any school tenant, user account, or system component of Aksharum.
• Uploading, transmitting, or sharing content that is unlawful, defamatory, offensive, or violates any third party's intellectual property rights.
• Reverse engineering, decompiling, modifying, or attempting to extract source code from any part of the Aksharum platform.
• Using the platform to send unsolicited bulk emails, SMS, or spam messages through the Communication or Notification modules.
• Transmitting viruses, worms, malware, or any code of a destructive nature.
• Attempting to circumvent the aptitude exam anti-cheat system, tamper with exam violation logs, or manipulate session data.
• Impersonating any user, role, or institution on the platform.
• Using automated scripts or bots to bulk-extract data, circumvent rate limiting, or overload platform infrastructure.

3. Payment & Billing

Aksharum offers subscription-based access to its platform. The following billing terms apply to all paying accounts:

• Trial period: Schools may access a free trial to evaluate the platform. The trial period duration is communicated during onboarding. No payment is required during the trial.
• Monthly billing: After the trial period, the service is billed monthly in advance. Billing is calculated based on the number of active students enrolled in the platform on the bill date.
• Student count: Students whose records have been marked as having left the school or have been deleted from the system do not count toward the billable student total.
• No partial refunds: There are no refunds or credits for partial months of service, unused months on an open account, or upgrade/downgrade adjustments within a billing cycle.
• Taxes: All fees are exclusive of applicable taxes, levies, or duties. You are responsible for all such charges applicable in your jurisdiction.
• Plan changes: Upgrades or downgrades take effect on the next billing cycle. Downgrading may result in loss of access to certain modules, features, or data capacity.
• Payment methods: Payments may be made via accepted online payment methods. You warrant that all payment details provided are accurate and that you are authorised to use the payment method.

4. Cancellation & Termination

Either party may terminate the use of Aksharum subject to the following conditions:

• Cancellation by school: You may cancel your account at any time by contacting us at hello@school2.app. No further payments are required after account cancellation.
• Immediate effect: If you cancel before the end of your current billing month, cancellation takes effect immediately and you will not be charged for the following month.
• Data export before cancellation: We strongly recommend exporting all results, attendance records, documents, and reports as PDF or XLSX files before initiating cancellation. Aksharum will provide a reasonable window for data export upon request.
• Termination by Aksharum: We reserve the right to suspend or terminate your account immediately if you violate these Terms, engage in abusive behaviour toward our team, or use the platform for illegal purposes.
• Data after termination: Following account termination, your school's data will be retained for a limited period per our data retention policy before being permanently deleted. Contact our team for specifics.

5. Modifications to the Service & Prices

Aksharum reserves the right to modify, update, or discontinue any part of the platform at any time.

• Feature changes: We may add, modify, or remove modules and features with or without prior notice. New features released as part of the platform are subject to these Terms.
• Pricing changes: Prices for all subscription plans are subject to change. We will provide at least 30 days' notice of any price changes via email to the registered School Admin and an in-platform notification.
• Module gating: The Super Admin controls which modules are enabled per school. Enabling or disabling modules may affect data collection, features available to users, and billing.
• No liability for changes: Aksharum shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

6. Data & Content Ownership

The ownership of data and content on the Aksharum platform is governed as follows:

• Your data is yours: Aksharum makes no claim to intellectual property rights over data you input into the platform — student records, attendance data, exam results, uploaded documents, salary information, or any other institutional data remain the property of your school.
• Uploaded documents: Files uploaded through the Document Sharing module — notes, assignments, circulars, salary slips — remain the property of the uploading institution or individual. Aksharum stores and delivers these files on your behalf.
• Exam content: Questions, papers, and content created in the Aptitude Exams module remain the intellectual property of the teacher or institution that created them.
• Platform content: The design, codebase, user interface, and all software components of the Aksharum platform are the exclusive intellectual property of Aksharum. You may not duplicate, copy, or reuse any part of the platform's HTML, CSS, or visual design without express written permission.
• Anonymised data: Aksharum may use aggregated, fully anonymised usage data to improve the platform. No personally identifiable information is used for this purpose.

7. Intellectual Property

All intellectual property rights in and to the Aksharum platform, including but not limited to its software, design, trademarks, and documentation, are owned by or licensed to Aksharum.

• You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from Aksharum.
• You may not modify, adapt, translate, or create derivative works of the Service or any part thereof.
• You may not use the Aksharum name, logo, or branding to imply association, endorsement, or partnership without prior written consent.
• All reports, exports (PDFs and XLSX files), and content generated by the platform using your data belong to your institution. The underlying report templates and generation engine are the property of Aksharum.

8. Disclaimer of Warranties

Aksharum provides the platform on an "as is" and "as available" basis. We do not warrant that:

• The service will meet all of your specific requirements or expectations.
• The service will be uninterrupted, timely, secure, or error-free at all times.
• The results obtained from use of the service will be accurate, reliable, or complete.
• Any errors or bugs in the service will be corrected within a specific timeframe.

While we implement robust security measures including session authentication, JWT tokens, OTP verification, encrypted transmissions, and database access controls, no system can guarantee absolute security. You agree to use the Service at your own risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Aksharum shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the platform, including but not limited to:

• Loss of data, profits, goodwill, or other intangible losses resulting from use or inability to use the service.
• Unauthorised access to or alteration of your school's data or transmissions.
• Statements or conduct of any third party on or through the service.
• Interruptions, slowdowns, or failures in service due to infrastructure, third-party providers, or force majeure events.
• Loss of content or features resulting from downgrading your subscription plan.
• Any costs incurred procuring substitute services following service disruption.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

• Entire agreement: These Terms constitute the entire agreement between you and Aksharum governing your use of the Service, superseding any prior agreements.
• Waiver: The failure of Aksharum to exercise or enforce any right under these Terms shall not constitute a waiver of that right.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
• Updates to Terms: We reserve the right to update these Terms at any time. Significant changes will be communicated via email to the registered School Admin and via an in-platform notification at least 14 days before the changes take effect.
